These terms and conditions apply to the use of the Retailstar web site (Site), including the use of any information, courses, content or services offered on this Site (Content). This Site is owned by Workstar Pty Limited ABN 45 097 871 933 (“Workstar”) and Retailstar is a trade mark of TodayCorp Pty Limited, Workstar’s parent company.
Please read these terms and conditions carefully before accessing or using the Content available through the Site. By using this Site, you agree to be bound by these terms and conditions. If you do not accept these terms and conditions, you must refrain from using the Site. These terms and conditions must be read in conjunction with any other applicable terms and conditions governing your use of this Site or Content (including but not limited to Workstar’s Terms and Conditions for Retailstar Shopbasics Courses and our privacy policy).
Terminology
In these terms and conditions, the expressions "we", "us" and "our" are references to Workstar.
The expressions “you” or “your” are references to you the user of this Site whether you are acting in your own capacity as an individual or as a representative of an organisation. If you are acting on behalf of an organisation, you warrant to us that you are authorized to accept these terms and conditions on its behalf.
Amendment to terms and conditions
We reserve the right to amend these terms and conditions from time to time. Amendments will be effective immediately upon posting on this Site. We will make reasonable efforts to notify users of amendments to the terms and conditions. Your continued use of the Site is your agreement to be bound by the terms and conditions as amended.
Access to the Web Site
In order to be able to access and use the Content offered on this Site, you or your employer must:
- complete and sign our order form
- agree to the Terms and Conditions for Retailstar Shopbasics Courses;
- pay the applicable fees.
You must also review our privacy policy and obtain a user name and password.
We reserve the right to terminate your access to the Site or any part of it if at any time you or your employer breaches these terms and conditions.
You warrant that all details you provide to us are true and accurate at all times. You must notify us of any change to the details as originally provided.
You must safeguard and keep your password confidential at all times and not share it with another person. You are responsible for the security of your password and will be solely liable for any use or unauthorised use using your password. If you become aware of misuse of your password, you must notify us immediately.
Courses
All Content provided through this Site is provided in good faith. We reserve the right to update the Content at any time. Courses provided on this Site are non-supported training and are non-accredited courses for the purpose of any Government grants or financial incentives or for any other purposes, and do not attract any formal assessment regime. We are not liable for any loss resulting from any action taken or reliance made by you on any Content. You agree to use our Content for lawful purposes only.
Disclaimer
We do not accept liability for any loss or damage, however caused (including through negligence), which you may directly or indirectly suffer in connection with or arising out of your use of this Site or any linked web site, your use of or reliance on any Content contained on or accessed through this Site or the unavailability of the Site or Content.
To the extent permitted by law, any term, condition or warranty which would otherwise be implied into these terms and conditions is hereby excluded. You may only use, download or print the Content for a course if you are enrolled to complete the course and only then for the purposes of your completion of that course. Downloaded or printed copies of Content must not be disclosed or distributed to any other person. Printouts of Content must appropriately attribute ownership of the Content to us.

Except where otherwise specified, any word or device used on the Site to which is attached the ™ or ® symbol is a trade mark of ours or our related bodies corporate and may be the subject of rights in other countries. You may only use our trade marks when referring to our products and services (other than in a manner that disparages us, our products or services (including this Site)) and only if you include a statement attributing that trade mark to us. You must not otherwise use any of our trade marks.

Unless we agree otherwise in writing, you are provided with access to this Site only for your personal use or the use of employees if you are an organisation.

These terms and conditions are governed by the laws in force in New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of that jurisdiction.
General
We accept no liability for any failure by us to comply with these terms and conditions where such failure is due to circumstances beyond our reasonable control.
If we waive any rights available to us under these terms and conditions on one occasion, this does not mean that those rights will be waived on any other occasion.
If any of these terms and conditions are held to be invalid, unenforceable or illegal for any reason, the remaining terms and conditions shall nevertheless continue in full force.
